1. Acceptance of Terms
By accessing or using the Obitix chain of custody platform, mobile applications, and related services ("Services") operated by Obitix Chain of Custody Solutions LLC ("Obitix," "we," or "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use our Services.
2. Description of Services
Obitix provides digital chain of custody software for funeral homes, crematories, hospitals, and regulators. Our Services include case tracking, QR code generation, real-time monitoring, compliance reporting, and related features as described in your subscription plan.
3. Account and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and comply with applicable laws when using our Services. You may not use the Services for any unlawful purpose or in a manner that violates these Terms.
4. Acceptable Use
You agree not to misuse the Services, including but not limited to: attempting to gain unauthorized access, interfering with or disrupting the Services, reverse engineering our systems, or using the Services to process data in violation of any law or third-party rights. We reserve the right to suspend or terminate accounts that violate these terms.
5. Intellectual Property
Obitix retains all rights, title, and interest in and to the Services, including all software, designs, and content. You receive a limited, non-exclusive, non-transferable license to use the Services in accordance with your subscription. You retain ownership of your data; we process it only as necessary to provide the Services.
6. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Your use of the Services is at your sole risk.
7. Limitation of Liability
To the maximum extent permitted by law, Obitix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
